DMV Hearings
When a driver is arrested and charged with DUI, they will take part in a criminal hearing and will also have the opportunity to participate in the DMV hearing, also known as they DDS or ALS hearing. A DMV hearing is an administrative license suspension hearing that is held by the Georgia Department of Driver’s Services. The outcome of this hearing will determine whether or not a person’s driver’s license will be suspended after being charged with DUI. After a DUI arrest, a driver only has 10 days to request a DMV hearing, otherwise their license will be automatically suspended, even if they do not end up being convicted of drunk driving. Driving privileges are very important to many people throughout Atlanta and having these revoked may cause many difficulties. Without a driver’s license, getting to work, traveling to school, and running every day errands can be a tedious task.
During the administrative license suspension hearing, several factors will be evaluated to determine the following:
- If you submitted to the breath or blood test, whether your blood alcohol level was above the legal limit
- Whether the officer had probable cause to believe you were driving under the influence
- Whether you were properly arrested
- Whether you were informed of the consequences of refusing a breath test or blood test
- Whether you refused the breathalyzer test or blood test
- Whether the tests were properly administered, the breath test machine was properly calibrated, etc.
Based upon the findings to the above questions, the hearing officer will either suspend the person’s driving privileges, or reinstate their license.
